1. Eligibility and information about other people

You must be at least 18 years old and able to agree to these Terms. By checking the required agreement box, you affirm that you are at least 18. The Oracle is intended for adults and may not be completed or submitted directly by a child. If you provide information about a child or another person, you represent that you are their parent or legal guardian or otherwise have permission and authority to provide and authorize our use of that information as described here. Do not provide information about anyone else if you lack that authority.

2. Information we collect

We may collect and retain:

• your name, email address, questionnaire responses, creative preferences, budget, location preferences, and information you choose to provide about participants;

• technical Wix form information and submission identifiers;

• the concepts, written analysis, styling and production guidance, prompts, generated or revised images, and internal generation and quality-review records created from your submission;

• your concept-sharing choice, feedback, correction requests, communications, mailing-list subscription, and marketing preferences;

• email-delivery status, timestamps, provider message identifiers, attempts, and errors;

• an unguessable concept-link token, referral code, referral names and email addresses, booking/referral status, and reward records;

• limited usage records such as concept visits, approximate unique browser sessions, booking or sharing clicks, referral visits, and session-request confirmations; and

• security and operational information, such as pseudonymous browser identifiers, hashed network-address fingerprints for failed administrative logins, error messages, logs, and provider request identifiers.

The Oracle does not intentionally request payment-card, government-identification, account-password, or medical-record information. If you voluntarily place unnecessary sensitive information in an open-text answer, it may be processed in the same way as the rest of your response.

The Oracle uses a first-party browser cookie containing a random identifier to estimate visits and actions associated with a concept or referral. It does not currently use third-party advertising scripts or track your activity across unrelated websites. Because the Oracle does not perform cross-site behavioral tracking, it does not currently respond differently to browser “Do Not Track” signals. If these practices change, we will update this policy and provide any choice required by law.

3. How we use information

To the fullest extent permitted by law, you authorize us and our service providers to use, host, copy, transmit, format, analyze, transform, combine, reproduce, create derivative material from, and otherwise process submitted information and Oracle outputs to:

• provide, personalize, revise, operate, troubleshoot, secure, and improve the Oracle and photography services;

• generate concepts, creative analysis, image prompts, images, and related recommendations using automated and artificial-intelligence tools;

• communicate with you, deliver your concept, respond to requests, and administer sessions, referrals, rewards, and client service;

• add your email address to the Erin Paris Photography mailing list and send studio news, photography information, promotions, offers, invitations, and other marketing communications;

• test prompts, compare outputs, assess quality, prevent repetitive concepts, develop workflows, conduct internal research, and improve our creative methods;

• maintain records, detect misuse, enforce these Terms, protect people and systems, resolve disputes, and comply with law; and

• create and use aggregated or reasonably de-identified information for analytics, research, operational improvement, future concept quality, creative-method development, and business planning.

This permission is worldwide, non-exclusive, royalty-free, and lasts for as long as we possess the relevant information. We may retain and use aggregated or reasonably de-identified information indefinitely where we do not reasonably attempt to identify you from it. You keep any rights you have in material you submit. You grant only the permission needed for the uses described in these Terms. You understand that AI-generated material may be inaccurate, may resemble material created for others, and may not qualify for intellectual-property protection.

We will use your sharing preference when deciding whether to feature your finished Oracle concept on our website, portfolio, advertising, or social media. Selecting “Yes, you may share it” grants us permission to publish, display, reproduce, edit, and promote the finished concept and its generated concept images without additional payment. This permission does not by itself authorize us to publish your raw questionnaire answers or identify a child by full name. Selecting “Please keep it private” tells us not to intentionally feature the finished concept publicly. You may change your choice by contacting us. We will make reasonable efforts to honor that choice, but no internet transmission, private link, human process, or vendor system is risk-free, and these Terms do not create a guarantee against accidental access or disclosure.

4. Where information goes

The Oracle depends on third-party providers:

• Wix collects the original questionnaire and sends a copy to the Oracle.

• Cloudflare hosts the application. Cloudflare D1 stores client, concept, activity, delivery, feedback, referral, and generation records; Cloudflare R2 stores generated and revision-source images; Cloudflare may also process requests, queues, logs, and backups.

• OpenAI receives questionnaire and concept information needed to generate the written concept and may receive intake-derived participant descriptions, prompts, concepts, and images to plan, generate, revise, or check concept images.

• Resend receives your email address and the delivery email, including the private concept link, to send the concept.

• Resend or another email-marketing provider may receive your email address, subscription status, engagement information, and unsubscribe status to manage and send marketing email.

• The session scheduler receives the referral code carried in the booking link and whatever information you enter there. It may send the Oracle a referral code, event type, and booking-submission identifier confirming a session request.

These providers process information under their own terms, privacy policies, systems, and retention practices. They may use subprocessors or process information in other locations. We do not control or guarantee their availability, security, retention, deletion, or other conduct. We may replace providers or add providers that perform similar functions without obtaining a new agreement, subject to any notice required by law.

We may also disclose information when reasonably necessary to comply with law or legal process; respond to emergencies; investigate fraud, abuse, security events, or Terms violations; protect our clients, business, property, or rights; complete a business reorganization, financing, sale, or transfer; or obtain professional advice and services. We do not currently sell personal information for money or share it for cross-context behavioral advertising.

By submitting the Oracle questionnaire, you agree to be added to the Erin Paris Photography mailing list and to receive marketing email from us. Marketing email may include studio news, photography information, promotions, offers, and invitations. You may unsubscribe at any time by using the unsubscribe link in a marketing email or contacting studio@erinparis.com. Unsubscribing from marketing does not prevent service messages needed to deliver or administer an Oracle concept, session, transaction, security notice, or request. We may retain an email address on a suppression list so that we can honor an unsubscribe request.

5. Retention, links, and deletion

Oracle records and client concept links may be retained indefinitely, including to provide a lasting client keepsake, maintain creative and business history, support referrals and client service, improve our work, document permissions, protect legal rights, and comply with business obligations. There is no scheduled expiration date for a client concept link. We may disable or delete a link or record at any time, but are not obligated by these Terms to do so unless applicable law requires it.

After a concept is successfully created, the Oracle replaces its untouched copy of the Wix webhook package with an empty record. A readable normalized version of the questionnaire remains. This does not delete the original Wix submission or provider copies.

You may ask us to provide a copy, correct information, change your sharing preference, disable your concept link, or delete information by emailing studio@erinparis.com. We may verify your identity and authority before acting. We will consider and handle requests as required by applicable law. Where a request is voluntary rather than legally required, we may approve or decline it in our discretion.

If we agree or are required to delete information, we will use reasonable efforts to delete or de-identify information within our practical control. Deletion may be incomplete or delayed because information may remain in Wix, email systems, the scheduler, service-provider systems, logs, security records, archives, caches, disaster-recovery copies, or backups until those systems are overwritten or expire. We may retain information needed for legal compliance, accounting, security, fraud prevention, dispute resolution, enforcement, documentation of consent or deletion, or other lawful purposes. We cannot delete copies saved or shared by you, a recipient of your link, or another independent person. Nothing in this section limits a non-waivable legal right.

6. Your concept link is not confidential

The concept link is long and difficult to guess, and the page asks search engines not to index it, but it is not password-protected and does not verify the viewer’s identity. It works like a bearer key: anyone who obtains it may be able to open the concept, view its images, and forward, copy, photograph, download, or screen-capture its contents. Links may be exposed through forwarding, shared devices, browser history, screenshots, email compromise, user error, vendor access, software defects, malicious activity, or circumstances beyond our control.

By choosing to receive or use a concept link, you accept these limitations and agree to share the link only at your own discretion. If you believe a link has been exposed, contact studio@erinparis.com and we can make reasonable efforts to disable it. Disabling a link does not erase copies already accessed or saved.

7. Security and incident limitations

We use practical measures intended to reduce risk, including restricted administrative access, signed sessions, non-indexing and no-cache instructions, private object storage, escaping submitted text before display, and avoiding full questionnaire contents in application logs. These are risk-reduction measures, not promises of confidentiality, perfect security, uninterrupted operation, or prevention of every unauthorized access, loss, alteration, misuse, or disclosure.

You assume the ordinary risks of transmitting and storing information online and of using email, AI providers, cloud services, and unpassworded bearer links. To the fullest extent permitted by law, we are not responsible for access, use, loss, or disclosure caused by your sharing or handling of a link; another recipient; a compromised email or device; third-party providers; internet or telecommunications failures; malicious actors; or events outside our reasonable control. Nothing in these Terms excludes responsibility that cannot legally be excluded, including any duty or remedy imposed by applicable privacy, consumer-protection, data-breach, or other law.

8. Creative-service limitations

Oracle content is provided for creative inspiration and planning. It may contain mistakes, unsuitable suggestions, unsafe or impractical ideas, or generated depictions that do not accurately represent participants. You are responsible for reviewing all advice, locations, props, wardrobe, activities, costs, permissions, accessibility needs, allergies, and safety considerations before acting. The Oracle does not provide medical, mental-health, legal, financial, or other professional advice and does not diagnose anyone or guarantee a photography outcome, booking, availability, price, or result.

Oracle results are generated using artificial-intelligence systems from information you provide, creative instructions and safeguards developed for the Oracle, and automated processing. A result is personalized creative output; it is not a statement, endorsement, belief, opinion, promise, or position of Erin Paris Photography. We work to make the Oracle respectful, constructive, and positive, but automated systems can misunderstand context or produce inaccurate, offensive, controversial, biased, unsafe, unlawful, or otherwise harmful material despite those efforts. You are responsible for reviewing a result before using, following, publishing, or sharing it. Do not use or share material that you believe may harm someone, violate a right or law, or create an unsafe situation. Please report concerning output to studio@erinparis.com so we can review it and, where practical, correct, replace, disable, or remove it. To the fullest extent permitted by law, Erin Paris Photography is not responsible for decisions or actions taken in reliance on Oracle output or for a user’s or third party’s publication, interpretation, adaptation, or misuse of that output. Nothing here excludes responsibility that cannot legally be excluded.

The Oracle is currently provided without a separate fee. We may charge for it or offer paid features in the future, but we will disclose the applicable price and additional payment terms before purchase. Charging for future use does not retroactively impose a fee on a completed free submission.

Subject to these Terms, you may use your delivered concept for your personal photoshoot planning. This permission is conditioned on attribution when the concept, Oracle-generated concept images, or photographs materially inspired by the concept are posted, published, displayed, or shared publicly, including on social media. In the accompanying caption or credit, you must state “Concept inspired by The Photoshoot Oracle” and tag @erinparis.photo wherever the platform supports tags. If tagging is unavailable, include “The Photoshoot Oracle by Erin Paris Photography.” The credit must be reasonably noticeable and must not falsely suggest that Erin Paris Photography created or photographed third-party photographs. You are responsible for communicating this requirement to a photographer, collaborator, business, or other person who publicly shares work made from your concept. Contact studio@erinparis.com before publication if a format cannot reasonably include the required credit.

This attribution requirement is a contractual condition of the permission granted by these Terms; it does not depend on every AI-generated element qualifying for copyright protection. Unless we agree otherwise in writing, you may not resell or commercially sublicense the Oracle concept itself, remove an attribution already included with Oracle material, claim that you created the Oracle service or generated concept, scrape or systematically copy the service, misuse private or administrative areas, interfere with the system, bypass access controls, or use the service or outputs to violate another person’s rights or law. Separate rights in photographs made during a photoshoot remain subject to the agreements between the photographer, client, and other applicable rights holders.

9. Disclaimers and limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE ORACLE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, CONFIDENTIALITY, OR SECURITY.

TO THE FULLEST EXTENT PERMITTED BY LAW, ERIN PARIS PHOTOGRAPHY AND ITS OWNER, PERSONNEL, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, OPPORTUNITIES, GOODWILL, OR EXPECTED RESULTS, ARISING FROM OR RELATED TO THE ORACLE, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE. TO THE FULLEST EXTENT PERMITTED BY LAW, TOTAL LIABILITY ARISING FROM OR RELATED TO THE ORACLE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID SPECIFICALLY FOR ACCESS TO THE ORACLE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR $100.

These exclusions and limits apply only where lawful. They do not waive rights or remedies that cannot be waived, and their enforceability depends on applicable law. Some jurisdictions do not allow certain warranty exclusions or liability limits

10. Changes, severability, and contact

We may update these Terms as the Oracle or its providers change. The “last updated” date identifies the current version. If a change materially affects information already submitted, we will provide any notice or obtain any consent required by law. Continued use after an update means acceptance only to the extent permitted by law.

California law governs these Terms to the extent legally permitted, without overriding consumer protections that apply under another jurisdiction’s mandatory law. If part of these Terms is found unenforceable, the remaining provisions will continue to the extent legally possible. These Terms do not replace a separately signed photography agreement; if the agreements conflict, the more specific signed agreement governs the photography service, while this document governs the Oracle and its data practices unless expressly stated otherwise.
